Alimony and divorce

Unlike child support, there are no mathematical calculations or formulas. Alimony is governed by statute. In order to be entitled to alimony you must be lawfully married. Florida law does not recognize common law marriages and/or palimony. In a proceeding for dissolution of marriage, the court may grant alimony to either party, which alimony may be rehabilitative or permanent in nature. In any award of alimony, the court may order periodic payments or payments in lump sum or both. The court may consider the adultery of either spouse, and the circumstances thereof in determining the amount of alimony, if any, to be awarded.

Relevant Factors in Determining a Proper Award of Alimony or Maintenance
• The standard of living established during the marriage.
• The duration of the marriage.
• The age and the physical and emotional condition of each party.
• The financial resources of each party, the non marital and the marital assets and liabilities distributed to each.
• When applicable, the time necessary for either party to acquire sufficient education or training to enable such party to find appropriate employment.
• The contribution of each party to the marriage, including, but not limited to, services rendered in homemaking, child care, education, and career building of the other party.
• All sources of income available to either party.
Types of Alimony or Spousal Maintenance
• Permanent Periodic Alimony: The two main factors that the a court will consider when determining whether to award a spouse permanent periodic alimony are: 1) duration of the marriage; and 2) whether there is a disparity between the spouse’s incomes. Marriages, generally speaking, fall into three categories: Short-Term Marriage (less than 9 years); Gray Area Marriage (Between 9 and 15 years) and Long-Term Marriage (most would agree that a marriage over 15 years is a long term marriage). The court can award permanent alimony in a long-term marriage and in a gray area marriage, depending upon the circumstances, the parties’ ages, health, young children, etc.

• Lump Sum Alimony: is exactly what it sounds like. Alimony paid in a lump sum of money to the other
• Rehabilitative Alimony: The purpose of rehabilitative alimony is to provide a spouse with the opportunity to become self-supporting by getting the necessary education and skills needed. This can include vocational school, college, and otherwise.
• Bridge the Gap Alimony: Alimony that is designed and intended to assist a person to transition from being married to single. A spouse might need some time to get a job or money for expenses of moving out and getting an apartment, and/or furniture. Usually Bridge the Gap alimony is usually for a short term (not more than a couple of years).

Imputing Income of Unemployed and Underemployed Spouses
Vocational experts are brought in if one of the spouses is unemployed or willfully underemployed. Their work experience, education, and skills are reviewed along with the job market. The courts are then told what the individual can expect to make based on the available jobs and the overall industry.

Learn How to Get Child Support Amount Modified:

Parents have the legal responsibility to provide for their child until he or she reaches the age of 18, or graduates high school – whichever happens later. However, if the minor child cannot graduate from high school prior to attaining the age of 19, the child support is terminated upon the child’s 18th birthday.
Child support may be modified by the court from time to time upon the showing by a party that there has been a substantial change in circumstance since the entry of the last court order. Usually the change in circumstance involves a parent’s income going up or going down, or one of the children emancipating. Other changes in circumstance exist that can cause a modification as referenced below.

Child support is governed by statute, and is determined by applying a mathematical formula using the “child support guidelines.” The mathematical formula takes into account a variety of factors including but not limited to:

• Net monthly income
• Daycare and/or aftercare expenses
• Health insurance
• Time sharing
Court Ordered alimony actually paid
• Court Ordered child support actually paid (from another relationship

When Circumstances Change:

The court has the power to modify child support when needed. However, this isn’t done automatically – for example, when one parent loses his or her job. You return to court and demonstrate the reason for the modification.

Certain life events can require modification of child support amounts. Some examples include:

• When one parent becomes unemployed
• When a child stops needing daycare
• When child’s medical needs change
• When a child’s educational needs change: Needing tutoring, going to a private school, higher tuition costs, special needs education, etc.
• If there is more than one child for which support is being paid and one of the children becomes emancipated

Current Economic Difficulties:

The child support worksheet is used to determine how much a parent pays each month. The final amount is primarily governed by income – the more money you make, the more money you will pay.
Considering the current economic climate – jobs are being lost, incomes are going down – more and more people are requiring a child support modification.

Determining Income:

The main determining factor in calculating child support is income. Each parent is required to report his or her income. However, the court doesn’t have to accept the figures provided. Sometimes people are voluntarily unemployed and/or under-employed. Some are self-employed and aren’t forthcoming with accurate numbers. In such cases, the court looks at a number of factors: Past employment history, education, earning potential, etc. Occasionally, expert witnesses come in and report a parent’s income-related information to the court. The court will go to great lengths to get the information needed to determine child support.
